Summary
A discipline committee of the Real Estate Council of British Columbia (the "Council") accepted the Consent Order Proposal submitted by Carmelita Pogado Testawich (Ms. Testawich") and Carmelita Obradovic Personal Real Estate Corporation and found that Ms. Testawich and Carmelita Obradovic Personal Real Estate Corporation committed professional misconduct in that:
- In or about June 2017, when acting as the agent for the buyer in the purchase of a property:
- Ms. Testawich failed to notify the representative of the seller, in a timely way, that the deposit had not been received, and
- Ms. Testawich failed to immediately notify her managing broker that a deposit had not been received in accordance with the Contract.
Results
A discipline committee of the Council has ordered, and Ms. Testawich and Carmelita Obradovic Personal Real Estate Corporation have agreed to, the following penalties:
- a reprimand;
- a discipline penalty of $3,500;
- enforcement expenses of $1,500; and
- successful completion of the Real Estate Trading Services Remedial Education Course.
