Summary
Mr. Singh committed professional misconduct while acting as a representative in that he:
- permitted an unlicensed assistant to:
- provide real estate services on behalf of the brokerage when he permitted the unlicensed assistant to make representations to an investigator relating to real estate;
- act deceptively when the unlicensed assistant offered to provide the investigator with a gift letter to the bank in order to conceal the fact that the funds for the down payment would not come from the investigator's personal funds;
- provide representations concerning obtaining mortgage funds to the investigator when he knew or ought to have known that the unlicensed assistant was not licensed to provide that advice;
- hold herself out as a mortgage specialist in his advertising when she was not licensed as a mortgage broker;
- acted deceptively when he advised the unlicensed assistant to give false information to a lending bank in order to obtain financing at a better rate;
- permitted false and misleading advertising when he:
- advertised himself as the Gill Team when he was not registered as a team with the Council;
- included the unlicensed assistant as part of the advertising without identifying her as an unlicensed assistant; and
- advertised the unlicensed assistant as providing mortgage services as part of the Gill Team when he knew or ought to have known she was not licensed to provide those services.
Results
A discipline committee of the Council has ordered the following:
- Mr. Singh licence is suspended for a period of twelve (12) months.
- Mr. Singh will not act as an unlicensed assistant during the time of his licence suspension.
- Mr. Singh must pay a discipline penalty of $5,000 to the Council.
- At his own expense, Mr. Singh must complete the Real Estate Trading Services Licensing Course and Examination.
- Upon completion of his suspension, a condition be placed on Mr. Singh's licence prohibiting him from engaging in the services of any unlicensed assistants for a period of five (5) years.
- Mr. Singh must pay enforcement expenses of $1,500 to the Council.
