Summary
A discipline committee for the Council has found that Tracy Liane Goodwin committed professional misconduct within the meaning of section 35(1) of the Real Estate Services Act.
Ms. Goodwin failed to disclose in writing to her client the amount of remuneration paid or payable to her brokerage; failed to promptly provide her managing broker with originals or copies of all trading records; failed to act honestly and with reasonable care and skill; and made a false or misleading statement in a document presented to the Council.
Results
In its Decision and Order with Respect to Penalty, a discipline committee of the Council ordered the following:
- Ms. Goodwin's licence is suspended for 30 days, from February 21, 2018 to March 22, 2018, inclusive. She must not act as an unlicensed assistant during the period of her licence suspension.
- At her own expense, Ms. Goodwin must successfully complete the Real Estate Trading Services Remedial Education Course.
- Ms. Goodwin may only practice under enhanced supervision conditions with a managing broker for one year following the date of this order.
- Ms. Goodwin must pay enforcement expenses of $5,500.00 to the Council.
