Summary
Stephen Patrick Burke represented a seller in a transaction, and agreed to provide the buyer, who was unrepresented, with services as a customer. Mr. Burke agreed to hold an addendum on a conditional basis for the buyer, but provided the addendum to the seller without checking if the condition was satisfied.
Licensees have a duty to act with reasonable care and skill. Mr. Burke failed in his duties, contravening section 3-4 of the Rules.
Results
A discipline committee of the Council has ordered the following:
- Mr. Burke is reprimanded, and must pay a discipline penalty of $1,000.00 to the Council.
- At his own expense, Mr. Burke must successfully complete the Real Estate Trading Services Remedial Education Course.
- Mr. Burke must pay enforcement expenses of $1,500.00 to the Council.
