Summary
Perry Keith Freeman, while licensed as managing broker with Colliers International Centre Group Commercial Realty, paid an unlicensed personal real estate corporation for real estate services provided on behalf of the brokerage. His actions contravened section 6-1 of the Rules, which prohibits licensees from paying unlicensed persons for real estate services.
Mr. Freeman failed to verify that the personal real estate corporation was in compliance with the licensing requirements of the Real Estate Services Act. This contravened his responsibilities under section 6(2) of the Real Estate Services Act, and sections 3-1(1) and 3-1(3)(b) of the Rules, which require managing brokers to ensure that their brokerages comply with all requirements under the Act, regulations, rules and bylaws.
Results
A discipline committee of the Council has ordered the following:
- Mr. Freeman is reprimanded and must pay a discipline penalty of $1,500.00 to the Council.
- Mr. Freeman must pay enforcement expenses of $1,500.00 to the Council.
As Mr. Freeman has a personal real estate corporation, the licence of Perry Freeman Personal Real Estate Corporation is also reprimanded, and is equally responsible for payment of the discipline penalty and enforcement expenses.
