Consent Order: February 22, 2017



Michael Thomas O’Grady represented a buyer and seller in the same trade in real estate. Mr. O’Grady did not disclose to the buyer that a bathroom in the property had been constructed without a permit and was not built to code. Licensees have an obligation to disclose to all parties in a trade, before any agreement to purchase is entered into, any material latent defect that is known to the licensee. Mr. O’Grady’s actions contravened section 5-13 of the Rules.

All licensees are required to act honestly and with reasonable care and skill. Mr. O’Grady failed in this duty, contravening section 3-4 of the Rules.

A discipline committee of the Council has ordered the following:

  1. Mr. O’Grady is reprimanded and must pay a discipline penalty of $2,500.00 to the Council.
  2. Mr. O’Grady must pay enforcement expenses of $1,500.00 to the Council.
