Summary
Yin Shuen Gilbert Lam, while licensed with New Coast Realty, provided rental property management services outside of the brokerage. This contravened section 7(3)(a) of the Real Estate Services Act, which states that licensees must not provide real estate services other than on behalf of the brokerage to which they are licensed.
Mr. Lam prepared rental property management agreements which did not include provisions respecting the use and disclosure of personal information, and descriptions of the records to be kept by the brokerage on behalf of the owner. This contravened the requirements of sections 5-1(4) and 5-1(5)(e) of the Rules.
Results
A discipline committee of the Council has ordered the following:
- Mr. Lam's licence is suspended for 28 days, from November 2, 2016 to November 29, 2016, inclusive.
- Mr. Lam is prohibited from providing services as an unlicensed assistant during his suspension.
- Mr. Lam must pay enforcement expenses of $1,500.00 to the Council.
