Summary
Yang Yang, while licensed as a representative with New World Realty Ltd., Vancouver, acted in a deceptive manner and demonstrated incompetence in the sale of a property.
Mr. Yang had never met or spoken with the buyer of the property; however he permitted his name to be recorded on the Contract of Purchase and Sale indicating he had an agency relationship with the buyer and had prepared the contract. In fact, Mr. Yang did not have an agency relationship with the buyer and had not prepared the contract.
Mr. Yang permitted his name to be recorded on the Working with a Realtor® brochure indicating he had an agency relationship with the buyer, when he did not have an agency relationship with the buyer.
Mr. Yang purported to record the personal information of the buyer on the Canadian Real Estate Association Individual Identification Information Record Form, when he had never met or spoken to the buyer.
Mr. Yang misled his brokerage as to its agency relationship with the buyer.
Results
A discipline committee of the Council has ordered the following:
- Mr. Yang is suspended for forty-five (45) days from May 18, 2016 to July 1, 2016 inclusive.
- At his own expense, Mr. Yang must successfully complete the Real Estate Trading Services Remedial Education Course.
- Mr. Yang must pay enforcement expenses of $1,500.00 to the Council.
