Summary
Martyn George Douglas, as the managing broker of Ocean Pacific, released to the buyer a deposit being held by Ocean Pacific as a stakeholder without the written agreement of the seller. Mr. Douglas' actions contravened sections 6, 28 and 30(2)(b) of the Real Estate Services Act and section 3-1(1)(b) of the Council Rules. Ocean Pacific contravened sections 28 and 30(2)(b) of the Real Estate Services Act.
Results
A discipline committee of the Council has ordered the following:
- Martyn George Douglas and RE/MAX Ocean Pacific Realty are reprimanded.
- They must pay a discipline penalty of $2,500.00 to the Council.
- They must pay enforcement expenses of $1,500.00 to the Council.
