Summary
Yang (Carl) Chu provided rental management services although he was not licensed for rental property management, and he provided these services outside of his related brokerage. This contravened sections 3(1)(a) and 7(3)(a) of the Real Estate Services Act (RESA).
Mr. Chu accepted remuneration for the rental management services he provided, and he failed to promptly pay the money he received to his brokerage. This contravened sections 27(1)(a) and/or 27(1)(b) of RESA.
Mr. Chu permitted and paid his unlicensed assistant to provide services for which a licence is required, including showing listings, performing move inspections, expending funds on behalf of an owner for repairs to a unit, and posting eviction notices. This contravened sections 6-1 and 6-2 of the Council Rules.
Mr. Chu failed to disclose to his managing broker, in writing, that he was managing property on behalf of himself and members of his family. This contravened sections 9-1 and 9-2(2) of the Council Rules.
Results
As Mr. Chu has a Personal Real Estate Corporation, disciplinary decisions by the Council apply both to Mr. Chu and to Carl Chu Personal Real Estate Corporation.
A discipline committee of the Council has ordered the following:
- Yang (Carl) Chu and Carl Chu Personal Real Estate Corporation are reprimanded.
- Mr. Chu must pay a discipline penalty of $3,000.00 to the Council.
- At his own expense, Mr. Chu must successfully complete the Real Estate Trading Services Remedial Education Course.
- Mr. Chu must pay enforcement expenses of $1,500.00 to the Council.
