NOTICE OF PERMANENT SURRENDER OF LICENCE

Robert Joseph Stang

Robert Joseph Stang, currently unlicensed, requested the Council to discontinue disciplinary proceedings against him as he decided to permanently surrender his real estate licence. Mr. Stang, while licensed as a representative with Realty Executives Cranbrook and then with Century 21 Maximum Realty Ltd., Cranbrook, was facing a disciplinary hearing into his professional conduct and would have been required to appear before a hearing committee of the Council to respond to these allegations.

The allegations against Mr. Stang in the Notice of Discipline Hearing are that he committed professional misconduct within the meaning of section 35(1)(a) of the Real Estate Services Act when he entered into an agreement to personally lease a commercial property while acting as the listing representative for the said property, which was:

  • contrary to sections 3-2(1) and 3-2(2)(a) of the Council Rules, he failed to inform his managing broker of the lease prior to entering into the lease and of the real estate services provided on behalf of his brokerage in that regard, and failed to provide his brokerage with records in relation to those real estate services; and
  • contrary to section 5-9 of the Council Rules, he failed to make prompt and appropriate disclosure of his interest in trade to the owner of the commercial property prior to entering into the lease.

There has been no discipline hearing or finding of fact with respect to these allegations, and no admissions to these allegations by Mr. Stang.

The Council was satisfied that, in the circumstances of this case, permanent surrender of Mr. Stang's licence in lieu of proceeding with disciplinary action was appropriate. The permanent surrender of Mr. Stang's licence was effective as of April 4, 2016, although his licence was surrendered to the Council on September 15, 2015.
