Summary
Minh Hai (John) Ly, while acting as a buyer's representative, failed to ensure that the Contract of Purchase and Sale for a property included a term requiring the seller to give legal notice to the tenant to vacate the property. He failed to ensure that the details of the tenancy were included in the contract and he failed to ensure that the buyer gave the seller a written request for vacant possession, as required by section 49 of the Residential Tenancy Act.
Mr. Ly failed to act with reasonable care and skill, and failed to act in the best interests of his clients. His actions contravened sections 3-4 and 3-3(a) of the Council Rules.
Results
A discipline committee of the Council has ordered the following:
- Minh Hai (John) Ly is suspended for seven (7) days from April 27 2016 to May 3 2016 inclusive.
- At his own expense, he must successfully complete the Real Estate Trading Services Remedial Education Course.
- He must pay enforcement expenses of $1,250.00 to the Council.
