ORDER TO FREEZE PROPERTY UNDER SECTION 46

Upon reading the Affidavit of Lisa Holst, Director, Accounting & Audit, of the Real Estate Council of British Columbia, sworn this 23rd day of November, 2011,

I AM OF THE OPINION that:

  1. There has been conduct on the part of Century 21 City View Realty Inc. dba Century 21 City View Realty (the brokerage) in respect of which a Discipline Committee could make an Order under section 43 of the Real Estate Services Act;
  2. The length of time required to complete an investigation or hold a disciplinary hearing, or both, in order to make such an order would be detrimental to the public interest; and
  3. It is in the public interest under sections 45 and 46 of the Real Estate Services Act to make such an order;

I CONSIDER IT in the public interest to make an Order under section 45(2)(a)of the Real Estate Services Act to suspend the licence of Century 21 City View Realty Inc. dba Century 21 City View Realty and an Order under section 45(2)(c) of the Real Estate Services Act that Century 21 City View Realty Inc. dba Century 21 City View Realty cease providing any real estate services to or on behalf of any member of the public.

FURTHER, I CONSIDER IT in the public interest to make an Order under section 45(2)(c) of the Real Estate Services Act requiring Century 21 City View Realty Inc. dba Century 21 City View Realty to cease all dealings with all brokerage bank accounts currently held at TD Canada Trust, North Vancouver Centre Branch, 1400 Lonsdale Avenue, North Vancouver, B.C. V7M 2J1: Branch Number 9640 including:

0XXX-XXXXXXX7 Trust General

0XXX-XXXXXXX1 Trust Commission

0XXX-XXXXXXX2 Trust Property Management

0XXX-XXXXXXX2 Trust Property Management

0XXX-XXXXXXX8 General Account

FURTHER, I CONSIDER it in the public interest to make an Order under section 45(2)(c) of the Real Estate Services Act requiring Century 21 City View Realty Inc. dba Century 21 City View Realty to deliver up all books, records, including computer records, and accounts of the brokerage with respect to its real estate services to the Real Estate Council of British Columbia.

FURTHER, I CONSIDER it in the public interest to make an Order under section 46(2)(a) of the Real Estate Services Act to prohibit Century 21 City View Realty Inc. dba Century 21 City View Realty or anyone purportedly on the behalf of Century 21 City View Realty Inc. dba Century 21 City View Realty from withdrawing any funds from the brokerage accounts, including the accounts named above, currently held at TD Canada Trust except as directed by the Real Estate Council.

FURTHER, I CONSIDER it to be in the public interest to make an Order under section 46(3) of the Real Estate Services Act requiring Century 21 City View Realty Inc. dba Century 21 City View Realty to hold, on deposit, under control or for safekeeping, any property of Century 21 City View Realty Inc. dba Century 21 City View Realty, until further direction of the Real Estate Council.

FURTHER, I CONSIDER it to be in the public interest to make an Order under section 46(3) of the Real Estate Services Act requiring TD Canada Trust, Branch 9640, North Vancouver Centre Branch, 1400, Lonsdale Avenue, North Vancouver, BC, to hold all trust funds, any other funds, securities, term deposits, and client accounts on deposit for Century 21 City View Realty Inc. dba Century 21 City View Realty, or in the name of Century 21 City View Realty Inc. dba Century 21 City View Realty until further Order of the Real Estate Council.

TAKE NOTICE that Century 21 City View Realty Inc. dba Century 21 City View Realty may, pursuant to section 45(6) of the Real Estate Services Act, require a disciplinary hearing to be held by delivering written notice to the Real Estate Council.
