A discipline committee of the Real Estate Council of British Columbia (the “Council”) accepted the Consent Order Proposal submitted by Teresa Marie Berge (“Ms. Berge”) and found that Ms. Berge committed professional misconduct when:
- while in her capacity as the buyer’s agent in the purchase of a property on a subject free basis, she did not specifically alert the buyer to the risk that the city might not approve a variance for the 224 square feet of unauthorized loft space in the property and she did not recommend independent inquiries of the city.
A discipline committee of the Council has ordered, and Ms. Berge has agreed to, the following penalties:
- a discipline penalty of $5,000; and
- enforcement expenses of $1,500.
