Summary
While acting as the listing agent for a new home built by an owner builder, Ms. Gill committed professional misconduct when she failed to ensure that a disclosure notice was provided to the prospective purchaser prior to the offer, as required by the Homeowner Protection Act.
Results
A discipline committee of the Council has ordered the following:
- Ms. Gill is reprimanded and must pay a discipline penalty of $1,500 to the Council.
- At her own expense, Ms. Gill must complete the course: Homeowner Protection Act: Protect Your Sellers and Yourself - offered by the Real Estate Board of Greater Vancouver.
- Ms. Gill must pay enforcement expenses of $1,500 to the Council.
As Ms. Gill has a personal real estate corporation, the licence of Raj Gill Personal Real Estate Corporation is also reprimanded and equally responsible for paying the discipline penalty and enforcement expenses.
