NOTICE OF PERMANENT SURRENDER OF LICENCE
Sally Eghbalesadat Shahram
Sally Eghbalesadat Shahram currently unlicensed, requested the Council to discontinue disciplinary proceedings against her as she had decided to permanently surrender her real estate licence. Ms. Shahram, while licensed as a representative with Multiple Realty Ltd. , Vancouver, was facing a disciplinary hearing into her professional conduct and would have been required to appear before a hearing committee of the Council to respond to these allegations.
The allegations against Ms. Shahram in the Notice of Discipline Hearing are that she committed professional misconduct within the meaning of section 35(1)(a) of the Real Estate Services Act, while acting as a designated agent in a court-ordered sale of a property located on West 10th Avenue, Vancouver, B.C. (the "Property") in which she had a one-half legal interest as a seller, in that she:
- failed to act honestly and with reasonable care and skill when she signed the Contract of Purchase and Sale both as a seller and as a witness to her signature as the seller, contrary to section 3-4 of the Council Rules; and
- failed to disclose her interest in the Property to the buyer in writing on a Disclosure of Interest in Trade form prior to entering into the Contract of Purchase and Sale, contrary to section 5-9 of the Council Rules.
There has been no discipline hearing or finding of fact with respect to these allegations, and no admissions to these allegations by Ms. Shahram.
The Council was satisfied that, in the circumstances of this case, permanent surrender of Ms. Shahram's licence in lieu of disciplinary action was appropriate. The permanent surrender of Ms. Shahram's licence was effective as of October 14, 2016, 2016, although her licence was surrendered to the Council on September 14, 2016.
