Summary
Ms. Campbell, while licensed as a managing broker with Campbell Strata Management Ltd. (CSM), committed professional misconduct while providing strata management services to a strata. In particular, Ms. Campbell failed to ensure CSM met its duties to its client to:
- follow up on a GST tax refund expected by the strata for over two years; and
- maintain records that would have allowed CSM to identify the GST payments made to the Canada Revenue Agency for the strata were mistakenly applied to the CSM's own GST account, in a timely way.
CSM committed professional misconduct while providing strata management services to a strata. In particular, CSM failed to:
- follow up on a GST tax refund expected by the strata for over two years; and
- maintain records that would have allowed CSM to identify the GST payments made to the Canada Revenue Agency for the strata were mistakenly applied to the CSM's own GST account, in a timely way.
Results
A discipline committee of the Council has ordered the following:
- Ms. Campbell and CSM each be reprimanded and must jointly and severally pay a discipline penalty of $5,000 to the Council.
- Ms. Campbell and CSM must jointly and severally pay enforcement expenses of $1,500 to the Council.
- At her own expenses, Ms. Campbell must successfully complete the Strata Management Remedial Education Course.
