Summary
Marshall Francis McAnerney provided real estate services and accepted payment for those services through Marshall McAnerney Personal Real Estate Corporation before the personal real estate corporation was licensed. Mr. McAnerney's actions contravened sections 3(1)(a), 7(3)(a) and 7(3)(b) of the Real Estate Services Act.
Results
A discipline committee of the Council has ordered the following:
- Mr. McAnerney is reprimanded, and must pay a discipline penalty of $5,000.00 to the Council.
- Mr. McAnerney must pay enforcement expenses of $1,500.00 to the Council.
As Mr. McAnerney has a personal real estate corporation, the licence of Marshall McAnerney Personal Real Estate Corporation is also reprimanded, and is equally responsible for paying the discipline penalty and enforcement expenses.
