Summary

A discipline committee of the Real Estate Council of British Columbia (the “Council”) accepted the Consent Order Proposal submitted by Marilyn Fawn Ball and Ian Alexander Heath and found that Ms. Ball and Mr. Heath committed professional misconduct when they failed to disclose to their seller clients the fact that they were to receive 2/3 of the commission allocated by the brokerage to the buyer’s agent with respect to the purchase and sale of three properties.

Results

A discipline committee of the Council has ordered, and Ms. Ball and Mr. Heath have agreed to the following penalties:

  1. Ms. Ball and Mr. Heath each pay discipline penalty of $2,500;
  2. Ms. Ball and Mr. Heath each pay enforcement expenses of $1,000; and
  3. Ms. Ball successfully complete the Real Estate Trading Services Remedial Education course.
