Summary

A discipline committee of the Real Estate Council of British Columbia (the “Council”) accepted the Consent Order Proposal submitted by Karl Marcus Leong (“Mr. Leong”) and Karl Leong Personal Real Estate Corporation (“KL Personal Real Estate Corporation”), and found that Mr. Leong and KL Personal Real Estate Corporation committed professional misconduct when in the capacity as the listing agent in the 2014 sale of a property, they published advertising on the Multiple Listing Service® that stated the property was a two-bedroom unit, when Mr. Leong knew, or reasonably ought to have known, that was a false or misleading representation; in that, the property only contained one bedroom and would need to be re-zoned as a legal two-bedroom unit.

Results

A discipline committee of the Council has ordered, and Mr. Leong and KL Personal Real Estate Corporation have agreed to, the following penalties:

  1. jointly and severally liable to pay a discipline penalty $5,000;
  2. jointly and severally liable to pay enforcement expenses of $1,500; and
  3. successful completion of the Real Estate Trading Services Remedial Education Course.
