Mr. Bruce committed professional misconduct when acting as the listing agent for a new home built by an owner-builder under the Homeowner Protection Act. Mr. Bruce did not ensure that a disclosure notice was provided to the buyer making an offer on the home, stating that the home was built under an Owner Builder authorization and whether the home was covered by a policy of home warranty insurance, prior to entering into a contract of purchase and sale.
Contraventions Real Estate Services Act
A discipline committee of the Council has ordered the following:
- Mr. Bruce is reprimanded and must pay a discipline penalty of $2,500 to the Council.
- Mr. Bruce must pay enforcement expenses of $1,500 to the Council.
- At his own expense, Mr. Bruce must successfully complete the Homeowner Protection Act: Protect Your Sellers and Yourself Course.
