Summary
A discipline committee of the Real Estate Council of British Columbia (the “Council”) accepted the Consent Order Proposal submitted by Adam Bradley Grainger (“Mr. Grainger”) and found that Mr. Grainger committed professional misconduct when, in June 2016:
- on behalf of a prospective buyer (“Buyer”), he co-prepared with BR, who was the designated agent for the sellers, a contract for the sale and purchase of a property, in which Mr. Grainger was identified as a limited dual agent when he was, in fact, the Buyer’s agent;
- he co-prepared with BR a contract in which he was identified as a limited dual agent without ensuring the Buyer signed a Limited Dual Agency Agreement which was separate from the contract; and
- he failed to disclose to the Buyer the nature of the representation he would be providing in the manner required under the Rules.
Results
A discipline committee of the Council has ordered, and Mr. Grainger has agreed to, the following penalties:
- a discipline penalty of $1,500;
- enforcement expenses of $1,500; and
- successful completion of the Real Estate Trading Services Remedial Education Course.
