Summary
On July 8, 2020, the Financial Services Tribunal (FST) dismissed an appeal filed by the Office of the Superintendent of Real Estate (the "OSRE"), at OSRE's request, to Mr. Liberatore’s Liability and Penalty Decisions of the Real Estate Council of British Columbia (the Council).
As a result of the FST’s decision, the Decision of the Council’s Discipline Committee is no longer stayed and its order will take effect.
On December 9, 2019, a Discipline Committee of the Real Estate Council of British Columbia (the "Council") accepted the Consent Order Proposal submitted by Joseph John Liberatore, and found that Mr. Liberatore committed professional misconduct when while acting as the buyer's agent in the sale of a property in or about October and November 2016, he failed to ascertain and advise his client that the building in which the property was located had suffered substantial water ingress damage, before the buyer entered a contract for the purchase of the property.
Results
A discipline committee of the Council has ordered, and Mr. Liberatore has agreed to, the following penalties:
- a discipline penalty of $5,000;
- enforcement expenses of $1,500; and
- successful completion of the Real Estate Trading Services Remedial Education Course.
