Summary
A discipline committee of the Real Estate Council of British Columbia (the "Council") accepted the Consent Order Proposal submitted by Russell James Churchill Buset Armstrong and found that Mr. Armstrong committed professional misconduct when acting as limited dual agent in relation to the purchase and sale of a property located in Armstrong, BC in 2017 he:
- failed to promptly deliver to his managing broker and brokerage all contract documents, including the exclusive listing contract with the sellers, the contract of purchase and sale, and other corresponding documents;
- failed to promptly submit the buyer's deposit into the brokerage; and
- failed to keep his managing broker informed of the real estate services he was providing to the sellers and to the buyer with respect to the purchase and sale of the property.
Results
A discipline committee of the Council has ordered, and Mr. Armstrong has agreed to, the following penalties:
- a discipline penalty of $7,500;
- enforcement expenses of $1,500; and
- successful completion of the Real Estate Trading Services Remedial Education Course.
