Summary
A discipline committee of the Real Estate Council of British Columbia (the "Council") accepted the Consent Order Proposal submitted by Pui (Ken) Chun Chan ("Mr. Chan") and found that Mr. Chan committed professional misconduct when he:
- As the listing agent in the December 2015 sale of a property in Burnaby (the "Property"), a new home built by an owner builder under the provisions of the Homeowner Protection Act ("HPA") in that:
- he failed to act with reasonable care and skill when he did not ensure that a disclosure notice was provided to a person making an offer to purchase the Property as required by s. 21(2) of the HPA, contrary to s. 3-4 of the Rules.
Results
A discipline committee of the Council has ordered, and Mr. Chan has agreed to, the following penalties:
- a reprimand;
- a discipline penalty of $1,500;
- enforcement expenses of $1,500; and
- successful completion of the Real Estate Trading Services Remedial Education Course.
