SUMMARY

A discipline committee of the Real Estate Council of British Columbia (the “Council”) accepted the Consent Order Proposal submitted by Carmelita Pogado Testawich (Ms. Testawich”) and Carmelita Obradovic Personal Real Estate Corporation (“Obradovic PREC”), and found that Ms. Testawich and Obradovic PREC committed professional misconduct in that:

In his capacity as agent for the seller in the July 2015 purchase and sale of a property in New Westminster (the “Property”), a new home built by an owner-builder, he failed to:

  1. In or about June 2017, when acting as the agent for the buyer in the purchase of a property:
    1. Ms. Testawich failed to notify the representative of the seller, in a timely way, that the deposit had not been received, and
    2. Ms. Testawich failed to immediately notify her managing broker that a deposit had not been received in accordance with the Contract.

RESULTS

A discipline committee of the Council has ordered, and Ms. Testawich and Obradovic PREC have agreed to, the following penalties:

  1. a reprimand;
  2. a discipline penalty of $3,500;
  3. enforcement expenses of $1,500; and
  4. successful completion of the Real Estate Trading Services Remedial Education Course.
