Summary

A discipline committee of the Real Estate Council of British Columbia (the "Council") accepted the Consent Order Proposal submitted by Larrie Andrew Forbes, and found that Mr. Forbes committed professional misconduct when acting as a buyer's agent in that he:

  1. failed to obtain, review, and provide to his client a complete set of strata documents prior to preparing a subject free offer to purchase the property;
  2. failed to make inquiries into the strata's roof replacement project prior to preparing a subject free offer;
  3. failed to advise his client to seek independent professional advice prior to preparing a subject free offer; and
  4. failed to insert into his client's subject free offer a hold-back clause respecting a possible special assessment arising from the strata's roof replacement project.

Results

A discipline committee of the Council has ordered, and Mr. Forbes has agreed to, the following penalties:

  1. a reprimand;
  2. a discipline penalty of $7,500;
  3. enforcement expenses of $1,500; and
  4. successful completion of the Real Estate Trading Services Remedial Education Course.
