Summary
A discipline committee of the Real Estate Council of British Columbia (the "Council") accepted the Consent Order Proposal submitted by Randy Clayton Dyck and Randy Dyck Personal Real Estate Corporation, and found that Randy Clayton Dyck and Randy Dyck Personal Real Estate Corporation committed professional misconduct when they:
- advertised or provided real estate services through a personal office;
- entered into a service agreement on behalf of the Brokerage that referenced "SXHXXXX Management", an unlicensed entity;
- failed to ensure that the rental property management service agreements he employed included the content required by section 5-1(4) and (5) of the Rules; and
- failed to adequately supervise an unlicensed party who was performing duties on their behalf.
Results
A discipline committee of the Council has ordered, and Randy Clayton Dyck and Randy Dyck Personal Real Estate Corporation have agreed to, the following penalties:
- a discipline penalty of $7,500, jointly and severally liable;
- enforcement expenses of $1,500, jointly and severally liable; and
- successful completion of the Real Estate Trading Services Remedial Education Course by Mr. Dyck.
