Summary
A discipline committee of the Real Estate Council of British Columbia (the "Council") accepted the Consent Order Proposal submitted by David John Black, and found that David John Black committed professional misconduct when he failed to ensure the business of the brokerage was carried out competently and failed to exercise reasonable care and skill when he advised the Listing Agents to revive the expired Contract of Purchase and Sale by preparing subject removal forms and an addendum to the Contract of Purchase and Sale.
Results
A discipline committee of the Council has ordered, and David John Black has agreed to, the following penalties:
- a reprimand;
- a discipline penalty of $2,000; and
- enforcement expenses of $1,500.
