Summary
Mr. Kler and Mr. Sharma, while licensed with OMAX Realty Ltd., committed professional misconduct while acting as listing agents for a property in Surrey which was a new home built by an owner-builder. They failed to ensure that an Owner Builder Disclosure Notice was provided to the buyer as required by the Homeowner Protection Act.
Results
A discipline committee of the Council has ordered the following:
- Mr. Kler and Mr. Sharma both be reprimanded and must each pay a discipline penalty of $1,500 to the Council.
- Mr. Kler and Mr. Sharma must each pay enforcement expenses of $1,500 to the Council.
- At their own expense, Mr. Kler and Mr. Sharma must both successfully complete the Real Estate Trading Services Remedial Education Course.
