Summary
Mr. Cochrane, while licensed with RE/MAX Alliance, committed professional misconduct while acting as a buyer's agent in the purchase of a property in North Saanich which was a new home built by an owner-builder. In particular he:
- failed to ensure that the buyers received a copy of a disclosure notice prior to making an offer of purchase and sale, which stated whether the property was built under an Owner Builder Authorization and whether the property was covered by a policy of home warranty insurance; and
- failed to immediately notify his managing broker that the deposit was not received into the brokerage's trust account on the date indicated in the contract.

Results
A discipline committee of the Council has ordered the following:
- Mr. Cochrane is reprimanded and must pay a discipline penalty of $4,000 to the Council.
- Mr. Cochrane must pay enforcement expenses of $1,500 to the Council.
- At his own expense, Mr. Cochrane must complete the Real Estate Trading Services Remedial Education Course.
- At his own expense, Mr. Cochrane must complete the course: Homeowner Protection Act: Protect Your Sellers and Yourself Course.
As Mr. Cochrane has a personal real estate corporation, the licence of Chris Cochrane Personal Real Estate Corporation is also reprimanded and equally responsible for paying the discipline penalty and enforcement expenses.
