Summary
Mr. McLane committed professional misconduct when he:
- published sales brochures listing his home address instead of his brokerage office address; and
- was acting as the seller's agent for a property, and represented in listing materials that the property had features when he knew (or ought to have known) that were incorrect:
- a security system;
- a sprinkler system;
- fully fenced; and
- built in 2013.
Results
A discipline committee of the Council has ordered the following:
- Mr. McLane's licence is suspended for seven (7) days. (Mr. McLane is suspended from January 2, 2019 to January 9, 2019, inclusive).
- Mr. McLane is prohibited from acting as an unlicensed assistant during his licence suspension period.
- At his own expense, Mr. McLane must complete the Real Estate Trading Services Remedial Education Course.
- Mr. McLane must pay a discipline penalty of $5,000 to the Council.
- Mr. McLane must pay enforcement expenses of $1,500 to the Council.
As Mr. McLane has a personal real estate corporation, the licence of Andrew McLane Personal Real Estate Corporation is also suspended, prohibited and equally responsible for paying the discipline penalty and enforcement expenses.
