Summary

Yue (Helen) Yin, while licensed with New Coast Realty, was a member of Team M.Y., and failed to disclose the nature of the representation that she would be providing to a buyer.

In her capacity as a designated agent, Ms. Yin did not promptly (if at all) disclose to the buyer client in writing the source of and amount of remuneration she anticipated receiving.

Ms. Yin crossed out, or alternatively, was complicit with her team leader (M.Y.) when she crossed out the financing and home inspection clauses without the buyer's knowledge, consent, or authorization. Further, she did not draw to the buyer's attention the implications of the crossed-out clauses.

Ms. Yin failed to promptly deliver a copy of an accepted offer to the buyer when it was signed and accepted by the seller, but instead left the signed contract on the doorstep of the buyer's residence which was situated in a townhouse complex.

When Ms. Yin was instructed by the buyer to insert an inspection clause back into the contract, she failed to do so (or act otherwise), despite indicating in a text message to the buyer client that she would.

When the buyer client told Ms. Yin that he would not be removing subjects, Ms. Yin failed to act in his best interests and in accordance with his lawful instructions, and failed to advise the buyer client to seek independent legal advice on matters outside of her expertise.

On the instruction of M.Y., Ms. Yin forwarded emails that she had received from the buyer client, without the buyer client's knowledge or consent. Ms. Yin advised the buyer's agent at the direction of M.Y. that the contract was subject free, could not be cancelled, and that the seller would sue him.

Ms. Yin did not act honestly or with reasonable care and skill when she told her buyer that his offer was unconditional, which was not the case.

Ms. Yin failed to maintain the confidentiality of the buyer client's information when she disclosed his personal phone number to M.Y. without getting the buyer client's authority to do so, and left a copy of the contract on the buyer client's doorstep.

Ms. Yin did not promptly provide the trading records to her managing broker, and failed to inform her managing broker of the real estate services being provided, and other activities being performed.

Ms. Yin advertised and held herself out as a member of Team M.Y., when M.Y.'s team name had not been approved by the Council.

Ms. Yin published advertising that she knew (or ought to have known) contained a false or misleading statement or misrepresentation. The MLS Listing that she prepared for a property indicated that the property had one covered parking stall, when in fact, the parking stall allocated to the property was not located in a covered area, but was actually situated outside the complex in an open area beside the visitor parking lot.
