Summary
Linda Louise Gabara entered into an agreement with a property owner to provide rental property management services. At the same time, Ms. Gabara entered into a separate contract with the owner to carry out renovations to the property and pay herself from the rental income.
Ms. Gabara carried out additional renovations to the property without obtaining instructions from the owner.
She also returned the security deposit to the tenants without the consent or approval of the property owner.
Ms. Gabara permitted payment to an unlicensed person who provided real estate services.
Results
A discipline committee of the Council has ordered the following:
- Ms. Gabara is reprimanded and must pay a discipline penalty of $5,000.00 to the Council.
- At her own expense, Ms. Gabara must successfully complete the Rental Property Management Remedial Education Course.
- Ms. Gabara must pay enforcement expenses of $1,500.00 to the Council.
