Xin Bo (Angela) Guo, while licensed with Metro Edge Realty, acted as the listing agent for a property which was a new home built by an owner builder. Ms. Guo did not ensure that the seller had provided the prospective buyer, prior to any offer being made, with a BC Housing Owner Builder Disclosure Notice as was required under the BC Homeowners Protection Act.

Ms. Guo acted as a limited dual agent in the assignment of a contract. She did not properly disclose the representation she was providing to the assignor and the assignee.

Ms. Guo drafted an unnecessary addendum to the assignment of the contract indicating that the assignor agreed to change the name on the title of completion to the assignee.

Ms. Guo did not take reasonable steps to avoid a conflict of interest or disclose the existence of that conflict of interest. She wrote an assignment of the contract on behalf of the assignee and did not disclose to the assignor that she was related to, and acting on behalf of, the assignee.

Results

A discipline committee of the Council has ordered the following:

  1. Ms. Guo must pay a discipline penalty of $5,000.00 to the Council.
  2. At her own expense, Ms. Guo must successfully complete the Real Estate Trading Services Remedial Education Course.
  3. Ms. Guo must pay enforcement expenses of $3,000.00 to the Council.

As Ms. Guo has a personal real estate corporation, the licence of Angela Guo Personal Real Estate Corporation is also reprimanded, and is equally responsible for paying the enforcement expenses and discipline penalty.
