Summary

Andrew Brian Laity, while acting as a designated agent for a seller in a transaction, emailed the buyer's agent stating that his client was being uncooperative in arranging access to the property. By doing so, Mr. Laity did not act in the best interests of his client, nor did he act with reasonable care and skill.

The buyers required vacant possession of the property. The sellers requested that Mr. Laity provide written confirmation of this requirement. Mr. Laity failed to fulfill this request, and therefore did not act in the best interest of his client, and did not act in accordance with the lawful instructions of his client.

He then provided his client's contact information to the buyer's agent. By doing so, he did not maintain the confidentiality of his client, and he did not act with reasonable care and skill.

Further, Mr. Laity did not disclose the nature of the representation he was providing as a designated agent to his client, as required.

Results

A discipline committee of the Council has ordered the following:

  1. Mr. Laity is reprimanded.
  2. At his own expense, Mr. Laity must successfully complete the Real Estate Trading Services Remedial Education course.
  3. Mr. Laity must pay enforcement expenses of $1,500.00 to the Council.
