Ms. Gorringe provided rental property management services without a proper written agreement in place.

Ms. Gorringe acted on behalf of owners of rental property in the strata. She was also licensed at the brokerage that was providing strata management services to the strata. This was a conflict of interest, which Ms. Gorringe did not disclose and take reasonable steps to avoid.

Ms. Gorringe did not disclose that even though she was licensed, she was not acting as a licensee in her role as a strata council member.

Ms. Gorringe circulated a resignation notice to the owners in the strata, which was outside the scope of her authority.

Ms. Lorenz, who was also a licensee at the brokerage, signed the management service agreement between the strata corporation and the brokerage as a member of the strata council. This was a conflict of interest, which Ms. Lorenz did not disclose and take reasonable steps to avoid.

Ms. Gorringe failed to ensure that a written service agreement was in place before providing rental property management services.

Ms. Gorringe failed to keep her client informed of the dates of a tenancy and the remuneration received. Licensees are required to keep their clients informed of the real estate services they are providing, which Ms. Gorringe failed to do.

Ms. Gorringe used her clients' security deposit as payment to cover rental arrears without the knowledge or consent of her client. By doing so, Ms. Gorringe acted outside her scope of authority.

Results

A discipline committee of the Council has ordered the following:

  1. Ms. Gorringe's licence is suspended for 21 days, from December 20 2017 to January 9 2018, inclusive. She must not act as an unlicensed assistant during the time of her licence suspension.
  2. Ms. Gorringe must pay a discipline penalty of $3,500.00 to the Council.
  3. Ms. Lorenz is reprimanded.
  4. Ms. Gorringe and Ms. Lorenz must each successfully complete the Rental Property Management Remedial Education Course at each's own expense.
  5. Ms. Gorringe and Ms. Lorenz are equally responsible for paying enforcement expenses of $1,500.00 to the Council.
