Summary
Benjamin Ng acted as a seller's agent in a transaction. He failed to act with reasonable care and skill, and failed to act in the best interests of his client when he did not:
- include a clause in the contract with respect to an existing tenant occupancy;
- advise the seller of the Residential Tenancy Act's requirements to enable the seller to provide vacant possession; and
- provide notice to the existing tenants to end the tenancy.
Results
A discipline committee of the Council has ordered the following:
- Mr. Ng is reprimanded, and must pay a discipline penalty of $3,000.00 to the Council.
- At his own expense, Mr. Ng must successfully complete the Real Estate Trading Services Remedial Education course.
- Mr. Ng must pay enforcement expenses of $1,500.00 to the Council.
As Mr. Ng has a personal real estate corporation, the licence of Ben Ng Personal Real Estate Corporation is also reprimanded, and is equally responsible for paying the enforcement expenses and discipline penalty.
