Summary
Jee-Man Thomas Park acted for both the buyer (a company) and seller as a limited dual agent in a single transaction. He did not disclose to the sellers until after the subjects had been removed, and only after the sellers questioned him, that:
- his sister was one of the owners of the corporate buyer,
- prior to subject removal he had entered into a short-term tenancy agreement for the Property, and
- he would be purchasing the Property by way of assignment of the contract of purchase and sale.
By doing so, he did not:
- act honestly and with reasonable care and skill,
- act in the best interest of his client,
- disclose material information, and
- disclose the potential for, or the existence of, a conflict of interest.
Results
A discipline committee of the Council has ordered the following:
- Mr. Park's licence is suspended for 45 days, from November 22, 2017 to January 6, 2018 inclusive. During this time, Mr. Park is prohibited from acting as an unlicensed assistant.
- Mr. Park must pay enforcement expenses of $1,500.00 to the Council.
- At his own expense, Mr. Park must successfully complete the Real Estate Trading Services Remedial Education Course.
- Mr. Park's licence include a condition requiring enhanced supervision by a managing broker for a period of not less than six months following the end of their licence suspension period.
As Mr. Park has a personal real estate corporation, the licence of Thomas Park Personal Real Estate Corporation is also suspended, includes the same condition requiring enhanced supervision on its licence, and is equally responsible for payment of the enforcement expenses.
