Summary
Colleen Marie Floris did not act in her client's best interests when she responded to her strata council client's termination notification in a manner which undermined the authority of the strata council.
Ms. Floris responded to the termination notification by submitting a resignation letter. In this letter, Ms. Floris alleged impropriety, illegal conduct, incompetence, and personal misconduct by the strata council and its members. By doing so, Ms. Floris acted outside of the scope of authority given by the strata council.
Ms. Floris advanced her brokerage's interests to continue providing management services by attempting to undermine the authority of the strata council to terminate her brokerage's services. Ms. Floris did not take reasonable steps to avoid a conflict of interest, as licensees are required to do.
Results
A discipline committee of the Council has ordered the following:
- Ms. Floris is reprimanded, and must pay a discipline penalty of $2,000.00 to the Council.
- At her own expense, Ms. Floris must successfully complete the Strata Management Remedial Education Course in the time period as directed by the Council.
- Ms. Floris must pay enforcement expenses of $1,500.00 to the Council.
