Summary
Lorraine Susan Fugle changed a fixed-term tenancy agreement to a month-to-month agreement without the written authorization or consent of her client, the property owner.
Licensees must:
- act in the best interests of their clients,
- act only within the scope of authority given by their clients and
- act honestly and with reasonable care and skill.
Ms. Fugle's actions contravened these requirements, found in sections 3-3(a), 3-3(c) and 3-4 of the Rules.
Results
A discipline committee of the Council has ordered the following:
- Ms. Fugle is reprimanded, and must pay a discipline penalty of $1,000.00 to the Council.
- Ms. Fugle must pay enforcement expenses of $1,500.00 to the Council.
