Summary
A discipline committee of the Council found that Johnson Castaneto Salanga committed wrongful taking and deceptive dealing and is guilty of conduct unbecoming a licensee.
Between October 2011 and June 2013, Mr. Salanga misappropriated over $100,000 from clients he represented as a buyer's agent.
Between July 2012 and June 2013, Mr. Salanga misappropriated $175,000 from a client; he falsely claimed the money was intended to complete renovations on the property the client wished to sell, and as a deposit on another property the client wished to buy.
In January 2013, Mr. Salanga acted as a seller's agent. He made false representations to, and misappropriated $16,850 from, his seller clients. This constituted deceptive dealing and wrongful taking.
In February 2013, Mr. Salanga misappropriated $70,000 from a client he represented as a buyer's agent.
Mr. Salanga's actions contravened sections 35(1)(c) and 35(2) of the Real Estate Services Act.
Results
In its Decision and Order with Respect to Penalty, a discipline committee of the Council ordered the following:
- Mr. Salanga is prohibited from applying for a licence under RESA for a period of 15 years from the date of this decision.
- Mr. Salanga must pay a discipline penalty of $10,000.00 to the Council.
- Mr. Salanga must pay enforcement expenses of $16,952.21 to the Council.
