Summary

Tamara Michelle Gray, while licensed with Sotheby's International Realty Canada, did not complete the Relicensing Education Program (REP) requirement before her licence renewal deadline. By not completing the required continuing education, Ms. Gray contravened section 2-8.1(2) of the Rules.

Ms. Gray made a false and misleading statement to Council, by submitting a licence renewal application indicating that she had completed the REP requirement when in fact she had not done so. This contravened section 35(1)(g) of the Real Estate Services Act.

After the Council advised Ms. Gray that her licence was expired she continued to provide real estate services, negotiating with clients on the purchase of a property. By providing services without a licence, Ms. Gray contravened 3(1)(a) of the Real Estate Services Act.

Ms. Gray did not inform her managing broker that she was continuing to negotiate a deal while she was unlicensed. Licensees have a responsibility to keep their managing brokers informed of the real estate services they provide on behalf of their brokerages. Ms. Gray's failure to keep her managing broker informed contravened section 3-2(2)(a) of the Rules.

Results

A discipline committee of the Council has ordered the following:

  1. Ms. Gray is reprimanded, and must pay a discipline penalty of $5,000.00 to the Council.
  2. Ms. Gray must pay enforcement expenses of $1,500.00 to the Council.
  3. Ms. Gray will not submit licence renewal applications to the Council without first: 1) completing the requisite Relicensing Education Program ("REP") requirements pursuant to section 2-8.1 of the Rules; 2) attaching evidence of proof of completion of the said REP requirements; and 3) obtaining the signature of her managing broker on such licence renewal applications;
  4. Ms. Gray, within three months of this Order must: a. thoroughly review with her managing broker the Professional Ethics chapter of the Real Estate Trading Services Licensing Course; b. submit to the council a certification signed by her managing broker confirming that she has completed the review of the Professional Ethics chapter with the managing broker; and c. prepare and submit to the Chair of the Council a statement which demonstrates, to the satisfaction of the Chair, that she has learned from this incident and from her review of the Professional Ethics chapter.
