Summary
Qing Yun (Terry) Deng, while licensed with New Coast Realty, altered the expiry dates of property listings so that they would terminate early and he could list the properties with Nu Stream Realty, where he planned to transfer his licence. He did this without the knowledge and consent of his managing broker, and contrary to the brokerage's policy about cancelling a listing.
Licensees are required to act honestly and with reasonable care and skill. Mr. Deng's actions contravened this requirement under section 3-4 of the Rules.
Results
A discipline committee of the Council has ordered the following:
- Mr. Deng's licence is suspended for 30 days, from August 2, 2017 until August 31, 2017, inclusive.
- Mr. Deng must pay a discipline penalty of $2,500.00 to the Council.
- Mr. Deng must be under the direct supervision of a managing broker for a period of not less than six months (following the end of the suspension period) as more particularly described in the terms of the Enhanced Supervision Conditions attached as Schedule 1 to this Consent Order.
- Mr. Deng must pay enforcement expenses of $1,500.00 to the Council.
As Mr. Deng has a personal real estate corporation, the licence of Terry Deng Personal Real Estate Corporation is also suspended, and is equally responsible for paying the discipline penalty and enforcement expenses.
