Summary
Catherine Michelle McGrath provided strata management services when she was not licensed to do so. Her actions contravened section 3(1)(a) of the Real Estate Services Act.
Ms. McGrath provided real estate services outside of her brokerage. Licensees may only provide real estate services on behalf of their brokerage. Ms. McGrath's actions contravened section 7(3)(a) of the Real Estate Services Act.
Ms. McGrath accepted remuneration for real estate services outside of her brokerage. Licensees may only accept remuneration for real estate services from their brokerage. Ms. McGrath's actions contravened section 7(3)(b) of the Real Estate Services Act.
Licensees are required to act with reasonable care and skill. By providing strata management services when she was not licensed to do so, Ms. McGrath contravened section 3-4 of the Rules.
Results
A discipline committee of the Council has ordered the following:
- Ms. McGrath is reprimanded and must pay a discipline penalty of $2,500.00 to the Council.
- Ms. McGrath must pay enforcement expenses of $1,500.00 to the Council.
- At her own expense, Ms. McGrath must successfully complete the Strata Management Remedial Education Course.
