Summary
Armando Jr. Balane Gonzaga failed in his responsibilities as a representative when he did not promptly provide his client's accepted offer to his managing broker, contrary to section 3-2(1)(b) of the Rules.
Mr. Gonzaga did not receive the deposit from his client within the time period required, and did not immediately inform his managing broker that he did not receive the deposit.
Licensees must immediately notify their managing broker if a deposit is not received within the time period required by the contract. Mr. Gonzaga failed to do so, contrary to section 3-2(2)(b) of the Rules.
Results
A discipline committee of the Council has ordered the following:
- Mr. Gonzaga is reprimanded and must pay a discipline penalty of $2,500.00 to the Council.
- Mr. Gonzaga must pay enforcement expenses of $1,500.00 to the Council.
- At his own expense, Mr. Gonzaga must successfully complete the Real Estate Trading Services Remedial Education Course.
As Mr. Gonzaga has a personal real estate corporation, the licence of Armando Gonzaga Jr. Personal Real Estate Corporation is also reprimanded, and is equally responsible for paying the discipline penalty and enforcement expenses.
