Summary
Lori Ann Pinter was acting as the strata manager for a property when she allowed holdback funds to be released to a seller without the proper authorization.
Ms. Pinter failed to act in the best interests of her client, and failed to act with reasonable care and skill, contravening sections 3-3(a) and 3-4 of the Rules.
Under Ms. Pinter's direction, a brokerage employee authorized the release of the holdback funds without client authorization. Licensees must act only within the scope of authority given by their clients. Ms. Pinter failed in this requirement, contravening section 3-3(c) of the Rules.
Results
A discipline committee of the Council has ordered the following:
- Ms. Pinter is reprimanded, and must pay a discipline penalty of $2,500.00 to the Council.
- Ms. Pinter will be under the direct supervision of a managing broker for a period of not less than one year following reinstatement or issuance of her licence, as more particularly described in the terms of the Enhanced Supervision attached as Schedule 1 to this Order. Ms. Pinter further agrees that the terms of Enhanced Supervision form part of this consent order, pursuant to section 41 of the RESA.
- At her own expense, Ms. Pinter must successfully complete the Rental Property Management Services Remedial Education Course.
- Ms. Pinter must pay enforcement expenses of $1,500.00 to the Council.
