Summary

Richard Charles Petersen, as managing broker at RE/MAX Action Realty, permitted the brokerage to pay an unlicensed Personal Real Estate Corporation for real estate services. Mr. Petersen's actions contravened section 7(3)(b) of the Real Estate Services Act, and section 6-1 of the Rules.

Mr. Petersen failed to ensure that the Personal Real Estate Corporation had complied with the licensing requirements of the Real Estate Services Act before he authorized the payment. This contravened section 6(2) of the Real Estate Services Act, and sections 3-1(1), and 3-1(3)(b) of the Rules.

RE/MAX Action Realty provided real estate services by a Personal Real Estate Corporation that was not licensed to or engaged by the brokerage. This contravened section 7(5)(a) of the Real Estate Services Act.

Results

A discipline committee of the Council has ordered the following:

  1. Mr. Petersen and RE/MAX Action Realty are each reprimanded, and are equally responsible for paying a discipline penalty of $5,000.00 to the Council.
  2. Mr. Petersen and RE/MAX Action Realty must pay enforcement expenses of $1,500.00 to the Council.
