Summary
Mr. Ng was representing the prospective buyer of a property in Richmond. He received a bank draft for $200,000 from another client of the brokerage in relation to a different property purchase. Mr. Ng mispresented this deposit to the Richmond property owners, leading them to believe that the money was a deposit for their property. Mr. Ng intentionally misrepresented the facts and acted in a deceptive manner. His actions contravened section 35(1)(c) of the Real Estate Services Act.
Mr. Ng failed to notify all parties involved in the purchase and sale of the Richmond property that a deposit had not been received, contrary to section 3-1(4)(a) of the Rules.
Results
A discipline committee of the Council has ordered the following:
- Mr. Ng's licence is suspended for 12 months, from October 26, 2016 until October 25, 2017, inclusive, and he cannot provide services as an unlicensed assistant during the time of this licence suspension.
- Mr. Ng must pay a discipline penalty of $10,000.00 to the Council.
- At his own expense, Mr. Ng must successfully complete the Broker's Remedial Education Course.
- Mr. Ng must pay enforcement expenses of $1,500.00 to the Council.
