Summary

Debra Ann Mowbray was acting for a buyer client in the purchase of a home which contained a primary dwelling and a rental dwelling. She failed to ascertain information regarding the property's zoning restrictions and failed to advise her clients that the property was legally non-conforming, in that the rental dwelling floor area exceeded the size permitted by the zoning laws.

Ms. Mowbray failed to act with reasonable care and skill, contravening section 3-4 of the Council Rules.

Ms. Mowbray failed to act in the best interests of her clients and failed to use reasonable efforts to discover relevant facts respecting the real estate that her clients were acquiring. Her actions contravened section 3-3(a) and 3-3(h) of the Council Rules.

Results

A discipline committee of the Council has ordered the following:

  1. Ms. Mowbray is reprimanded and must pay a discipline penalty of $2,500.00 to the Council.
  2. Ms. Mowbray must pay enforcement expenses of $1,500.00 to the Council.
